This Agreement is between you and Hennepin County, a political subdivision of the State of Minnesota (“Hennepin County”), for use of Hennepin County Online Services and the various applications, products, and utilities available thereunder ("Hennepin County Online Services").
Hennepin County provides access to and use of Hennepin County Online Services subject to your compliance with all the terms, conditions, and notices contained or referenced herein. In addition, when utilizing specifically authorized online resources (e.g., online housing services and/or Sentence to Serve scheduling), you shall be subject to any terms and conditions applicable to such resources in addition to those set forth in this Agreement. All such additional terms and conditions are hereby incorporated by reference into this Agreement.
BY COMPLETING THE REGISTRATION PROCESS AND/OR USING THIS SITE, YOU AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT WISH TO BE BOUND BY THE THESE TERMS OF USE, PLEASE EXIT THE SITE NOW. YOUR REMEDY FOR DISSATISFACTION WITH THIS SITE, OR ANY PRODUCTS, SERVICES, CONTENT, OR OTHER INFORMATION AVAILABLE ON OR THROUGH THIS SITE, IS TO STOP USING THE SITE AND/OR THOSE PARTICULAR PRODUCTS OR SERVICES. YOUR AGREEMENT WITH HENNEPIN COUNTY REGARDING COMPLIANCE WITH THESE TERMS OF USE BECOMES EFFECTIVE IMMEDIATELY UPON COMMENCEMENT OF YOUR USE OF THIS SITE.
PLEASE READ THIS AGREEMENT AND INDICATE YOUR ACCEPTANCE BY CLICKING THE “CREATE” BUTTON AND CREATING A HENNEPIN COUNTY ACCOUNT. ACCEPTANCE OF THIS AGREEMENT MEANS THAT YOU ARE BOUND BY THE TERMS OF THIS AGREEMENT AND ANY AMENDMENTS THERETO AFTER THIS DATE.
As a user of Hennepin County Online Services, you may be asked to register with Hennepin County and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information, including your ID and password. You are also responsible for all activities that occur under your account or password.
You agree to use Hennepin County Online Services only for purposes directly related to official business with Hennepin County or its departments, personnel, programs, or other services offered thereby. You further agree not to create an account on behalf of another person or to allow another person to use your ID or password for any reason.
You agree to abide by any rules or regulations that Hennepin County might adopt and publish with respect to conduct of users of Hennepin County Online Services and related resources, which rules and regulations are hereby incorporated into this Agreement by this reference (as amended from time to time). You shall be obligated to check the Hennepin County Online Services website for any changes in such rules or regulations. Without limiting the generality of the foregoing, when using Hennepin County Online Services, you agree to the following:
Hennepin County may terminate your access to Hennepin County Online Services at any time, for any reason.
ALL SERVICES PROVIDED BY HENNEPIN COUNTY ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND TO YOU OR ANY THIRD PARTY, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE USE, SECURITY OR PERFORMANCE OF THIS SERVICE. Hennepin County Online Services is a computer application and as such, may not be error free or interruption free. System requirements are subject to change.
IN NO EVENT WILL HENNEPIN COUNTY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOST REVENUES OR LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA, EVEN IF HENNEPIN COUNTY IS EXPRESSLY ADVISED OF THE POSSIBLITY OF SUCH DAMAGES.
You shall defend, indemnify, and hold harmless Hennepin County, its present and former officials, officers, agents, volunteers and employees from any liability, claims, causes of action, judgments, damages, losses, costs, or expenses, including attorney’s fees, resulting directly or indirectly from any act or omission by you and/or anyone for whose acts and/or omissions you may be liable in your use of the services described in this Agreement, and against all loss by reason of your failure to perform any obligation under this Agreement. For clarification and not limitation, this obligation to defend, indemnify and hold harmless includes but is not limited to any liability, claims, or actions resulting directly or indirectly from alleged infringement of any copyright or any property right of another, and/or use of protected data, or other noncompliance with the requirements of these provisions.
The laws of the state of Minnesota shall govern all questions and interpretations concerning the validity and construction of this Agreement and the legal relations between the parties and their performance. The appropriate venue and jurisdiction for any litigation will be those courts located within the County of Hennepin, state of Minnesota. Litigation, however, in the federal courts involving the parties will be in the appropriate federal court within the state of Minnesota.
